一 | 공정위, 석유유통 대리점계약서 개정사후정산 폐지, 발주때 공급가 확정앞으로 주유소는 계약을 맺은 정유사의 석유제품을 60% 이상 구매하면 다른 정유사 제품도 최대 40%까지 구매할 수 있게 된다. 또 한 달 뒤 월평균 가격을 기준으로 최종 매입가격을 정하는 ‘사후정산’ 방식도 원칙적으로 폐지되고, 제품을 발주하는 시점에 가격이 확정된다.이에 따라 정유사 간 공급가격 경쟁이 촉진되고 주유소의 제품 구매 및 판매가격 결정 자율성도 높아질 전망이다. 주유소 간 가격 경쟁이 확대되면서 소비자들이 보다 저렴한 가격에 석유제품을 구매할 수 있을 것으로 기대된다.공정거래위원회는 26일 이 같은 내용을 담아 ‘석유유통업종 표준대리점계약서’를 개정했다고 밝혔다. 표준대리점계약서는 석유제품을 공급하는 정유사와 이를 소비자에게 재판매하는 주유소 간 대리점 거래에 적용된다.이번 개정은 최근 중동전쟁에 따른 국제유가 급등으로 석유제품 공급가격이 오르는 과정에서 정유사와 주유소 간 전속거래와 사후정산 관행의 문제점이 부각된 데 따른 것이다. 특정 정유사 제품을 전량 구매하는 전속거래로 주유소의 구매 선택권이 제한되고, 제품을 공급받은 뒤 한 달가량 지나 월평균 가격으로 정산하면서 최종 매입가격이 뒤늦게 확정되는 구조가 문제로 지적됐다.개정 표준계약서에는 주유소가 계약한 정유사 제품을 월별 총 구매량의 60% 이상 구매하는 범위에서 구매량을 합의하도록 명시했다. 이에 따라 다른 정유사 제품을 최대 40%까지 구매할 수 있다. 정유사는 혼합구매를 이유로 공급가격이나 공급물량, 거래조건을 부당하게 차별해서는 안 된다.다만 혼합구매가 이번에 새롭게 허용되는 것은 아니다. 현행 공정거래법상 정유사가 주유소에 100% 전량 구매를 강요하는 것은 이미 금지돼 있다. 이번 개정은 기존 업계 합의사항을 표준계약서에 명문화해 거래관행을 개선하려는 취지라고 공정위는 설명했다.사후정산 방식도 원칙적으로 폐지된다. 정유사는 주유소가 제품을 발주한 시점의 공급가격으로 대금을 결정해야 한다. 현재는 발주 시점 가격으로 우선 구매한 뒤 한 달 뒤 월평균 가격으로 정산해 최종가격 확정까지 시차가 발생한다. 사후정산제가 폐지되면 거래조건의 투명성이 높아지고 주유소의 경영 불확실성도 완화될 것으로 예상된다.주유소가 요청하면 사후정산을 예외적으로 적용할 수 있지만 이 경우에도 발주 이후 시장 상황 변화 등을 반영해 7일 이내에 대금을 결정해야 한다.양영경 기자。 “It’s Independence Day.
